Tribunal admits alleged jail record, Florida police report, others, against Abiodun

Ogun State Election Petition Tribunal, Wednesday, admitted in evidence a Certified True Copy (CTC) of an alleged incident report from Florida MetroDade police department and the CTC of an alleged jail booking record against Governor Dapo Abiodun of Ogun State.

The court also admitted in evidence, preloaded credit card, allegedly used by the All Progressives Congress, APC, and Abiodun, to buy votes during the March 18 election in the state.

The Tribunal also admitted picture of thugs allegedly carting away ballot boxes on motorcycle.

Peoples Democratic Party, PDP and its gubernatorial candidate, Ladi Adebutu, had accussed Abiodun, during the buildup to the election, of being jailed in 1986 for credit card fraud in Miami Dade Florida, USA.

At the resumed hearing on Wednesday, Chris Uche (SAN), Counsel to PDP and Adebutu, called one of their principal witnesses, Oyejide Sunkanmi, the youth leader of PDP in the state to give evidence against Abiodun.

Oyejide while being led in evidence by the prosecution counsel, tendered the documents and urged the Tribunal to admit them as evidence against Abiodun.

Oyejide in his witness statement on oath referred to an alleged jail booking record and incident report from Florida MetroDade police department against Abiodun.

Other documents tendered were: two letters written by the PDP to INEC complaining about the breach of the principle of margin lead while declaring Abiodun as the winner of the election.

Dr. Remi Olatubora (SAN), counsel to INEC; Prof. Taiwo Osipitan (SAN), representing Abiodun and Dr. Onyechi Ikpeazu (SAN) reserved their objections to the admissibility of the documents till their final written addresses.

PDP and Adebutu in their petition marked, EPT/OG/GOV/03/2023 are challenging the victory of Abiodun over alleged non-compliance with the Electoral Act and corrupt practices during the election.

The petitioners insisted that Abiodun did not win majority of the lawful votes cast at the polls.

However, an attempt to tender a video recording which allegedly captured violence and disruption of the March 18 election in some parts of the state, was objected by the respondents' lawyers.

In his words, Olatubora described the documents as "cancerous", saying the video is a hearsay and should not be admitted by the court.

He quoted Oyejide as having said that the videos were downloaded from Channels Television and Arise Television websites, saying the videos were not reliable.

Reacting, Uche said the Tribunal needs to admit the document before it could determine whether it is hearsay or not.

The PDP lawyer maintained that the respondents ought to reserve their objections till final addresses as stated in the prehearing report.

He urged the court to discountenance the objections of the respondents and admit the video evidence, which was to be played in court.

Meanwhile, the Tribunal, after listening to the arguments of the petitioners and the respondents, reserved its ruling on the video ebidence till Thursday.
