An Oyo State High Court, sitting in Ibadan, the Oyo State capital has ruled that the State House of Assembly can go ahead with the impeachment process of the embattled Deputy Governor of the State, Engr Rauf Olaniyan.
Justice Ladiran Akintola, Thursday, dismissed the suit filed by the Deputy Governor to stop Assembly from removing him from office, saying the Assembly has complied with the provisional constitution in the process.
In his judgment, the court held that the House of Assembly has not breached the provisions of the constitution on the removal of governor or deputy governor.
According to the court, the lawmakers substantially complied with the provisions of Section 188 of the Constitution on the removal process, adding that it should continue with the removal process.
Meanwhile, Olaniyan has appealed the judgement dismissing the suit.
Counsel to Olaniyan, Chief Afolabi Fashanu (SAN), confirmed the appeal by the deputy governor.
The Deputy Governor has approached the court to stop the process of his impeachment initiated by the Assembly.
The Assembly had accused the Oke-Ogun born politician of gross misconduct, following which 24 lawmakers signed the impeachment notice of the Deputy Governor.
