Man sues Abeokuta Pharmacy for dispensing wrong drug, demands N51 million damages

A resident of Abeokuta, the Ogun State capital, Nosiru Rasheed, has dragged a pharmacy, ‘Trust Plus Pharmaceutical Stores’, before an Ogun State High Court, over a pharmacist’s negligence which almost cost him his life.

The Claimant, according to the court papers obtained by HorizonTimes alleged that he was sold the wrong medication, which landed him in hospital two hours after taking the wrong medication.

Rasheed, who lives along Quarry Road in Abeokuta, said he had only gone to the pharmacy on January 5, 2025 to buy the popular Andrew Liver Salt to ease stomach pains, but Epsom Salt was handed over to him.

He said the pharmacist on duty assured him and advised him professionally that 'Epsom salt ... has the same potency as the Andrew Liver salt.'

He said he took the professional advice and took Epsom salt in place of Adrew Liver Salt, but became uncomfortable after two hours of using the wrong drug. 

According to him, his doctors later confirmed that Epsom Salt was unsuitable and dangerous for his condition as it is not on the same class of drug.

“I told the pharmacist I needed Andrew Liver Salt. He insisted Epsom Salt would work the same way. I trusted his professional advice. By that night, I was in terrible pain and could barely breathe,” Rasheed recalled in statement of claim.

According to him, around 11:00 pm the same night, he became severely uncomfortable and contacted his doctor, who advised immediate hospital admission.

He said he was first rushed to Angel and Eagles Hospital, Abiola Way, Abeokuta, where doctors informed him that Epsom Salt and Andrew Liver Salt were not even in the same class of drugs.

He was later admitted to Lafiya Hospital, Ayetoro Garage, where he received urgent treatment.

“The doctor told me that Epsom Salt is for bleaching skin and external use, while Andrew Liver Salt is for bowel relief. He said if I had delayed a few more hours, I might have died,” Rasheed said.

In his suit, Mr. Rasheed is demanding 1 million reimbursement for hospital bills and 50 million in general damages for the trauma he suffered.

He also seeks a court declaration that the pharmacy acted negligently and unprofessionally.

His legal team, R.R.A & Associates, described the incident as “a clear case of negligence that could have ended tragically.”

Court records show that Mr. Rasheed had, through his lawyers, written two letters of complaint to the pharmacy in April, one of which was allegedly refused to be acknowledged.
