Supreme Court has dismissed the application of former Vice President Atiku Abubakar to file fresh evidence before the court against the election of President Bola Ahmed Tinubu.
Justice John Inyang Okoro, while reading the judgement posited that the appellant did not fulfil the preconditions for the acceptance of fresh evidence in appeal.
According to him, appeal court is a follow up to the lower court, adding that the appellant had about a year to have sought for the document he pleaded to tender in disposition from the Chicago State University.
He wondered why the appellant waited until the lower court delivered its judgement before the searching for the document, maintaining further that case of forgery was not before the court.
"This application does not fit into the issue submitted for determination for this appeal. The application, my Lord, of the appellant/applicant in this circumstance is hereby refused and accordingly dismissed."
The court is now hearing the main appeal.
