The court of appeal sitting in Abuja has faulted the allegation of overvoting in some polling units in Osun State Governorship election.
It has however reinstated Governor Ademola Adeleke as the validly elected governor of Osun state.
Delivering judgment in the appeal filed by Adeleke on Friday, a three-member panel of justices held that the election tribunal erred when it ruled that the 1st and 2nd respondents (Gboyega Oyetola and the All Progressives Congress) proved their allegation of over-voting.
According to the panel of judges which issued its verdict on Friday, the tribunal was wring to have admitted an evidence and ruled on the same in isolation, without considering the voters register in the disputed polling units.
“The Tribunal was wrong to have admitted evidence in isolation of the voters register from the disputed polling units,” the judgement said in part.
